Legal Studies 2

This module provides the student with a comprehensive understanding of the current legislation applicable to the work of their profession. It will equip the student with the skills necessary to apply the relevant legal principles in a social care environment and the ability to recognise when to seek professional legal advice. As law is an ongoing and dynamic subject the syllabus content will be expanded of modified, as the case may be, to reflect developments in the law set out in this module.In order to progress, all components of module assessment must be passed by students – failure to successfully to complete any component will require repeat assessment/exam.

Tort

The nature of Tort. Tort of Negligence. Tort of Defamation.

Equality

Equality legislation, Disability legislation, discrimination, harassment, sexual harassment, victimisation. Human Rights.

Health and Safety

Health and Safety legislation. Common Law and statutory duties, bullying/stress.

Data Protection

Data Protection legislation. Freedom of Information legislation. Protected Disclosures legislation.

Consent

Mental Capacity legislation, European Convention on Human Rights, UN Convention on Rights of Persons with Disabilities.Undue Influence.
