Legal Studies 1

This Module introduces the student to the Irish Legal System and the impact of the role of public administration on care services. It provides a comprehensive understanding of the sources of Irish Law and the current legislation applicable in the area of child protection. It will equip the student with the skills necessary to apply the relevant legal principles in a social care environment and the ability to recognise when to seek professional legal advice. As law is an ongoing and dynamic subject the syllabus content will be expanded or modified as the case may be, to reflect developments in the law set out in this module.In order to progress, all components of module assessment must be passed by students – failure to successfully to complete any component will require repeat assessment/exam.

Sources of Law

Common Law, Equity, Doctrine of Precedent, Statute, EU Law, Irish Constitution.The Irish Courts and Judicial System. In camera rule.

The Irish Constitution

Background and history, Framework Articles. Institutions of the State, role and functions. Separation of Powers, Fundamental Rights Articles, natural/implied rights. Definition of the Family. Amendments.

Public Administration

Overview of public administration in Ireland. Work of government departments and impact on the formation of socio economic policy. Role of interest groups and contemporary social issues. Role and finance of state sponsored bodies operating in the social care field. Judicial Review.

Protection of Children

Status of Children, Child Care legislation. Relevant family law legislation. Guardianship and custody. Care Proceedings, Welfare Principle. Statutory duty of Child and Family Agency, Role of Tusla. Child Abduction and statutory regulation. The Luxembourg Convention, The Hague Convention. Domestic violence: legislative framework, orders available and enforcement

Adoption

Placement, Adoption procedure, Adoption legislation. Consent. Inter country adoption. Tracing.
