The aim of this semester 4 module is to advance the students understanding of the law regulating the relationship between landlord and tenant both in the residential and commercial market. (Land ownership & transfer not relevant to this module).

Landlord and Tenant Law

Statute of Frauds; Deasy's Act 1860; The Land and Conveyancing Law Reform Act 2009. Commercial (FRI) leases and recentdevelopments (definition, obligations, rent reviews); Leasehold and Licences.

Property Management Law

Multi Unit Development Act (2011). Regulatory Provisions for Property Service Providers - including most up to date legislation (e.i. pressure zones)

Leasehold and Licences

Creation of landlord tenant relationship; Types of relationship; Residential Tenancies Act 2004

Commercial Lease

Commercial Lead recent developments (including break clauses). Essential contents; Term and Renewal; Rights; Break Options; Assignment/Subletting. Repair Obligations; Lender Consent; & VAT.

Residential Lease

Landlord and Tenant obligations pursuant to the 'Residential Lease' Tenancies Act, 2004-2018 and the Planning and Development (Housing) and Residential Tenancies Act 2016.
